1. General Terms and Conditions of Sale

The updated version of Safety Fuel's General Terms and Conditions of Sale is always accessible online by the Customer, by clicking on General Terms and Conditions of Sale. The General Terms and Conditions of Sale govern the commercial relations between Safety Fuel and its Customer (the "Customer"), who declares that he accepts them without reserve. All orders placed through the site www.Safety-fuel.com, as well as all related services, are subject without reserve to the General Sales Conditions. These represent the entirety of the reciprocal commitments of Safety Fuel and the Customer who expressly accepts them. They apply for the entire duration of their publication on the site www.Safety-Fuel.com. The Customer acknowledges having read and accepted the General Terms and Conditions of Sale defined on the site www.Safety-fuel.com, before placing the order, by checking the box "I accept the General Terms and Conditions of Sale". Unless Safety Fuel has given its prior, express and written agreement, the General Terms and Conditions of Sale shall prevail over any other condition.

2. Products

The products are presented on the website in accordance with legal requirements and as accurately as possible. However, the photographs, video films, diagrams or drawings of the products are only illustrations; they cannot guarantee a perfect representation of the products, in particular because of the differences in the rendering of the colours and the materials according to the hardware and computer software used. Safety Fuel cannot be held responsible for the inaccuracy of the photographs appearing on its site. Safety Fuel invites the customer to refer to the description of each product to know the precise characteristics. Safety Fuel expressly reserves the right at any time to add new products, to remove all or part of the products sold or presented on the site, to change their presentation or to cease their marketing on its site, and this, without being obliged to inform the Customer beforehand.

 3. Controls

3.1 Managing and creating an account

When the customer places an order, the information followed by an asterisk are compulsory and are thus necessary for the treatment of the order of the Customer, who commits himself to the fact that the communicated information is complete, exact and up to date. In case of incomplete or inaccurate information, Safety Fuel reserves the right to cancel the order and the eventual payment. In case of error in the customer's details, Safety Fuel is not responsible for possible problems in the delivery of the order. The Customer can, at any time, modify the information that he has registered for his account. The Customer will receive his invoices by e-mail after having validated the order.

3.2 Placing and validating an order

Any order for a product implies the consultation and express acceptance of the General Terms and Conditions of Sale, without this acceptance being conditional on a handwritten signature by the Customer. The taking of an order on the site is subject to the strict respect of a procedure described below and concretized on line by a succession of different screens on which are indicated the different phases that the Customer must follow to validate his order by Safety Fuel. In order to constitute his Basket, the Customer chooses the products and the quantities he wishes to order, and validates the whole by clicking on the button [add] or [Add to basket]. In the My Cart screen, the Customer can at any time delete a product, modify the quantities or exit to return to the shop. The simple fact of adding a product in the basket is not worth validation of the order because the product can become unavailable between the moment of the addition in the basket and the validation of the order by the Customer. Safety Fuel commits itself to honour the orders received within the limit of available stocks. In order to validate his order and pay, the Customer must click on the button [Confirm]. A summary of the order indicates in particular the selected products, the cost of the delivery and the total to be paid. By clicking on the [Place your order] button, the customer can then validate their delivery address. The last screen allows the customer to register their payment online. After validation of his order by the bank payment service, the customer receives an order confirmation by email at the address he indicated when placing his order. Safety Fuel will inform the customer by e-mail of possible stock shortages that could affect the order. In the absence of proof to the contrary, the data recorded by Safety Fuel's automatic registration systems establish the nature, content and date of the order. Safety Fuel reserves the right to ask the customer for proof of identity to definitively confirm the delivery of the order. This verification is not systematic. When it takes place, the customer is informed by e-mail in the 5 days (except Sunday and holidays) which follow the validation of the order. Safety Fuel reserves the right to cancel any order of a customer in case of violation by this customer of his contractual obligations under this order and/or the previous order. The information given by the customer during the order taking, engage this one: in case of error in the wording of the coordinates of the recipient, Safety Fuel could not be held responsible for the possible problems of delivery.

 4. Delivery

Delivery shall be made by Safety Fuel's carriers in the areas delivered by Safety Fuel. The delivery is made within 48 hours of the order by handing over the ordered products to the announced recipient. It is up to the customer to always check his parcel at the arrival. If he notices damage and wishes to express reservations about the delivery, it is up to the Customer to express clear and precise reservations on the delivery note to the person who gives him his parcel, without prejudice to his right to claim the defectiveness of the delivered product. The Customer shall then send an e-mail to the following address: info@safety-fuel.com If no reservations are made as indicated above, the order shall be considered as accepted and the products as delivered. In the event of apparent defects, the Customer benefits from the right of withdrawal under the conditions set out in Article 5. In the case of a technical product, the Customer shall take particular care to check the correct operation of the appliance delivered and to read the enclosed instructions for use. If the Customer wishes to have 2 delivery locations, he/she shall place 2 orders, with the related delivery costs. If the Customer is absent at the time of delivery, the carrier will leave a delivery notice in the Customer's letterbox. A second delivery is then made the following day. If the Customer is absent again, a second delivery notice will be left in the letterbox and the Customer will be asked to contact the carrier via the following sites to make an appointment for a third delivery attempt. The customer will be provided with a link to track their order and if necessary contact the carrier. If there is no contact within 5 days, the order is returned to the Safety Fuel warehouse and will be considered complete without refund to the customer. However, the customer can ask Safety Fuel within 5 working days for a new delivery, by paying the delivery costs. If a delivery is to be made to a company, a contact person must be provided.

In case of force majeure Safety Fuel shall be released from its obligation to deliver. Safety Fuel shall inform the customer within a reasonable time of cases and events of force majeure that may disrupt the delivery process. However, if 8 days after the requested delivery date, the Product ordered has not been delivered, for any other reason than a case of force majeure, the sale can be cancelled at the request of the Customer by e-mail to info@safety-fuel.com. The delivery costs are as follows: Germany Belgium France Luxembourg Other countries contact us at the following email address info@safety-fuel.com Delivery costs are offered as soon as the total of the basket reaches the sum of 60 Euros, with the exception of certain products where the delivery costs will be mentioned on the product sheet. 

5. Withdrawal - Exchange - Refund

The consumer has a period of 14 days from the effective delivery (the "Withdrawal Period") to exercise his right of withdrawal, without having to give any reason; only the return and delivery costs will be at his expense. When the Withdrawal Period expires on a Saturday, Sunday or public holiday, this period is extended until the next working day. The right of withdrawal cannot be exercised, unless the parties have agreed otherwise, for contracts for the supply of goods made to the consumer's specifications or clearly personalised or which, due to their nature, cannot be returned or are likely to deteriorate or expire quickly (e.g. fresh produce, fruit and vegetables, etc.). In case of exercise of the right of withdrawal, Safety Fuel is only obliged to reimburse the amount of the order. The refund will be made by Safety Fuel within a maximum of 15 days of the return to the Safety Fuel warehouse, by crediting the account that was debited for the order. Safety Fuel reserves the right to propose in priority to the customer a refund in the form of a voucher on new order. In case of request of exchange or refund, the Customer sends back the new article, preferably in its original packing, accompanied by all the possible accessories, instructions for use and documentations, the invoice, his Customer number and his order number to the following address

The products returned incomplete, damaged, used or soiled by the Customer, which would not have been the subject of reserves at the time of the delivery, could neither be taken back, nor exchanged, nor refunded. Safety Fuel does not accept parcels sent by postage due or cash on delivery. Any risk linked to the return of the product is at the expense of the Customer.

6. Awards

The price indicated on the product sheet of each item is expressed in euros; it does not include delivery costs; these are indicated on the Delivery Method page of the Shopping Cart. The prices of the products can be modified at any time and without notice. The products will be invoiced on the basis of the prices in force at the time the order is placed. In the Summary of my basket and the order confirmation, the total price is the final price, expressed all taxes and VAT included. This price includes the price of the articles and the delivery costs (handling, packaging and conservation of the products, transport and delivery costs).  

7. Invoicing and payment

An invoice is issued for each delivery and sent to the Customer by e-mail. Any complaint concerning the invoices, must be brought to the attention of Safety Fuel by e-mail within 10 days of their reception at info@safety-fuel.com. Otherwise they are considered to be accepted without any reservation. The price invoiced to the Customer is the price indicated on the order confirmation sent by Safety Fuel by e-mail. The price of the products is payable in cash on the day of the order according to one of the methods available on the Safety Fuel site. The order validated by the customer will be considered effective only when the concerned bank payment centre has given its agreement. In case of refusal of the banking centre, the order will be automatically cancelled and the Customer warned by e-mail.  

8. Limitations of liability of Safety Fuel

While taking the greatest care in putting on line the information and data freely available on its site and in updating them, Safety Fuel cannot be held responsible for any inaccuracies, errors or omissions that may have crept into the description of the products. Moreover, Safety Fuel cannot be held responsible for typographical errors appearing in its site or for a visual of the product which would not be up to date. In the same way, the photographs and graphics which illustrate, with the support of the text, the products, are only indicative and do not enter the contractual field. They do not engage Safety Fuel which cannot be held responsible for inaccuracies or errors which could be introduced. More generally, Safety Fuel cannot be held responsible for: - interruptions or delays recorded on its site because of the execution of maintenance work, technical breakdowns, a case of force majeure, the fact of third parties or any circumstances whatsoever, independent of its will; - the impossibility of momentarily accessing its site, due to facts independent of its will, such as the cases of interruptions of the Internet network or of failure of the material of connection of the Customer to the Internet network.   

9. Legal guarantee

For any technical problem or request for information, please write to the following address: info@safety-fuel.com. When returning an item under warranty, it should preferably be returned in its original packaging, accompanied by all possible accessories, instructions for use and documentation, and the return agreement email from Safety Fuel's customer service. Any incomplete return or whose packing is deteriorated will be refused and not refunded to the Customer. 

10. Settlement of disputes

This contract is subject to Belgian law. In the event of a problem relating to the application of the General Terms and Conditions of Sale, and before taking any legal action, the Customer may seek an amicable solution, in particular with the help of a professional association in the sector, a consumer association or any other advisor of his choice. As a general rule and subject to the discretion of the Courts, compliance with the provisions of the General Terms and Conditions of Sale relating to the contractual guarantee presupposes: - that the Customer honours its financial commitments to Safety Fuel - that the Customer uses the product in a normal manner. Complaints or disputes will always be received with kindness, good faith being always presumed in the one who takes the trouble to expose his situation.

In the event of a dispute between the parties, it is expressly agreed that the courts of Liège shall have jurisdiction.

The contractual information is presented in French. Non-emancipated minors do not have the legal capacity to contract and therefore cannot place orders on the website www.Safety-fuel.com. All elements of the site (texts, photographs, illustrations, brands, logos, icons, etc.) are the exclusive property of Safety Fuel and/or its suppliers, and are protected by Belgian and international laws relating to the respect of copyrights and brands. Any total or partial reproduction or representation of the content of the site, by any means whatsoever, without the prior and express written consent of Safety Fuel is prohibited and illegal. The non-observance of this prohibition constitutes a counterfeit which can engage the civil and penal liability of the counterfeiter. Any use of the elements of the site www.safety-fuel.com .com for purposes other than consultation, in particular for public, commercial or humorous purposes, may be subject to legal proceedings in Belgium and abroad.

12. Discretionary policy

In the context of distance selling, and for the processing and routing of orders, the drawing up of invoices and guarantee contracts, the Customer must necessarily provide personal information. The Customer's address is necessary in order to deliver the order. The telephone number of the Customer allows the deliverymen and the Customer service of Safety Fuel to contact the Customer for the follow-up of his order. The e-mail address of the Customer allows Safety Fuel to communicate easily with the Customer. To ensure the safety of the banking transactions, the banking information of the Customer (number of bank card, date of validity) are encrypted by the SSL system. The absence of this information leads to the non-validation of the order. The Customer is informed of the fact that, during his visits to the www.safety-fuel.com website, a cookie may be automatically installed on his browser. This cookie does not allow the user to be identified but is used to record information relating to the user's navigation on the site. The purpose of using these cookies is to personalise the presentation of the site for each visitor. The Customer may decide to oppose the recording of these "cookies" by configuring his browser. 

 13. Non-waiver

The fact that Safety Fuel refrains from demanding at a given moment the execution of any of the provisions of the General Terms and Conditions of Sale cannot be interpreted as a waiver of the right to invoke the said total or partial non-execution later. 

14. Validity of the General Terms and Conditions of Sale

If any of the provisions of these General Terms and Conditions of Safety Fuel are declared invalid in whole or in part, the other provisions and the other rights and obligations arising from these General Terms and Conditions of Sale shall remain unaffected and applicable.
